These Terms govern the use of {APP_NAME} as a technology intermediary (marketplace).

1. Beta notice and scope

{APP_NAME} may operate in a Beta/testing environment. Features may change, be discontinued, or experience instability. Use is at your own risk, without prejudice to rights granted by law.

The platform acts exclusively as a technology intermediary connecting independent users (families and professionals). We are not an agency, not an employer, and we do not provide care services.

2. Acceptance, eligibility, and account

By accessing and using {APP_NAME}, you agree to these Terms. If you do not agree, do not use the platform.

  • You must provide true and up-to-date information.
  • You are responsible for keeping your credentials confidential.
  • We may suspend or terminate accounts for violations, security, or compliance reasons.
3. Platform nature (critical clause)

{APP_NAME} does not supervise, perform, or guarantee the care services. We facilitate contact, communication, and, where applicable, payment processing.

Hiring decisions, service conditions, and service execution are solely the responsibility of the users involved.

4. User relationship and no employment link

{APP_NAME} does not create an employment relationship with professionals and does not represent any user. Professionals act as independent providers and are responsible for their legal, tax, and professional obligations.

5. Responsibilities and due diligence

Families and professionals must act diligently. We recommend checking references, experience, certifications, and clearly agreeing on scope, schedule, and specific needs.

  • Families must provide accurate information about the care environment and routines.
  • Professionals must act ethically and within their capabilities, as agreed with families.
  • In emergencies, contact local emergency services.
6. Payments, fees, and (where applicable) holds

Payments may be processed by third-party partners. {APP_NAME} may charge a platform fee. Any funds hold/release follows operational rules and does not guarantee service quality.

{APP_NAME} is not an arbitrator and does not guarantee correct service performance. Disputes should be primarily resolved between users, without prejudice to security and compliance actions.

7. Verifications (KYC) and profiles

We may perform checks and request documents. Such checks are supportive measures and do not constitute certification, guarantee, or endorsement.

8. Reports, safety, and disputes

In case of serious reports (e.g., abuse, negligence, violence, fraud), {APP_NAME} may suspend accounts, preserve evidence, temporarily hold funds, and cooperate with authorities.

{APP_NAME} does not act as a judge or private arbitrator.

9. Limitation of liability

{APP_NAME} is not responsible for:

  • Abuse, negligence, physical/psychological harm, property damage, or breaches between users.
  • Indirect losses, lost profits, data loss, or consequential damages.
  • User conduct, omissions, or promises.

To the maximum extent permitted by law, {APP_NAME}’ total liability, if any, is limited to the total platform fees paid by the user in the previous three (3) months.

10. Intellectual property

All platform content, trademarks, and software are owned by {APP_NAME} or licensors and protected by intellectual property laws.

11. Changes and termination

We may update these Terms and suspend/terminate accounts for security, compliance, suspected fraud, or violations. Changes become effective upon publication.

12. Governing law and venue

These Terms are governed by Brazilian law. Venue is the District of São Paulo/SP, unless mandatory law provides otherwise.
